The Noor Hotels & Resorts PERSONAL DATA PROTECTION GUEST INFORMATION TEXT

This information is provided by GÜNEY EGE OTEL İŞLETMELERİ VE YÖNETİM HİZMETLERİ ANONYMOUS ŞİRKETİ (“The Noor”) in its capacity as the data controller within the scope of the provisions of the Data Controller’s obligation to inform regulated in Article 10 of the Personal Data Protection Law No. 6698 (“LPPD”).

Processing of Your Personal Data, Its Purpose and Legal Reason

1. Your Personal Data Processed Due to Accommodation and Services Received

a. Identity information (name and surname, date of birth, Turkish identity number), Contact Information (address, e-mail address, telephone number), Accommodation Information (room number), Customer Transaction (call center and hotel solution center records, request-complaint information, payment information, invoice information), Physical Space Security (hotel entry and exit record information of guests, security camera records, vehicle license plates), information you share here if you use The Noor Assistant, Transaction Security (log and traffic information if you use The Noor wifi network), information regarding the people staying with you are processed by The Noor. These personal data are processed for the primary purposes of carrying out accommodation transactions within the scope of the service agreement between our Customers and us, providing support during and after the service, increasing the quality of service, ensuring communication, conducting customer relations processes, providing you with personalized services, conducting your accommodation insurance transactions, conducting accounting, finance and legal processes, and connecting to the wi-fi network. Relevant personal data is processed in accordance with Article 5 of the KVKK, for the legal reasons that it is prescribed by the laws (Tax Procedure Law, Identity Notification Law, Consumer Law, Law No. 5651 and other relevant legislation), that data processing is mandatory for the establishment and performance of a contract, that data processing is necessary for the establishment and protection of a right and that it is necessary for the legitimate interests of the data controller.
b. Audio Recordings (Reception, Call center and hotel solution center conversation voice recordings) are processed in order to ensure customer satisfaction and quality standards and to improve the services in accordance with Article 5 of the KVKK, for the legal reasons that data processing is mandatory for the establishment and protection of a contract, that data processing is mandatory for the establishment and protection of a right and that it is necessary for the legitimate interests of the data controller.

2. Your Personal Data Processed for the Purposes of Sending Commercial Messages: Your identity (name, surname) and contact information (telephone, e-mail addresses), your choices and preferences regarding your accommodation and the service you receive, the personal data you transmit through The Noor Assistant, based on your explicit consent; It will be processed for the purposes of informing you about our campaigns, products and services, sending SMS, calls, e-mails and commercial messages.

3.Your Personal Data Processed with The Noor Hotels & Resorts Hotel Mobile Application: During your stay, we also provide our valued customers with services within the scope of hotel and accommodation via the mobile application. Your personal data received for the purpose of benefiting from the restaurants, accommodation reservations and service groups in the Services category in the Application in The Noor Hotels & Resorts Application are processed based on the legal grounds of establishing a contract or performance and establishing a right in accordance with KVKK Art. 5/2.

4. Your Personal Data Regarding Social Media Sharing: Your public photos and videos that you publish on social media regarding your stay at The Noor may be published on The Noor social media accounts if you tag The Noor accounts, based on the legal ground of “being made public by the relevant person himself/herself”.

5. Visual and Audio Recordings Obtained During Events and Organizations: Photo and video recordings taken in areas open to hotel guests or general participation or shooting areas during events and organizations held at The Noor are processed to be shared on social media and digital channels. In this way, if you choose to be in areas where photos and videos are taken, your personal data is processed and shared based on the legal reason of “publicization by the relevant person” in accordance with Article 5 of the KVKK.

c. Collection Method of Your Personal Data

i. Your Personal Data is processed automatically and non-automatically through forms you fill out at the reception, digital forms you fill out on websites, requests and communications during your stay at the hotel, online applications, cookies, digital forms, digital marketing technology tools, call center, mobile application, e-mails, search engines, 3rd party websites that share data with us based on your permission, social media channels and physical environment agencies, printed forms, direct communication through our dealers, sales and marketing officers, our agencies, travel companies, tour operator membership forms, targeting, profiling, online behavioral advertising methods, and our solution partners. Security camera recordings in common areas of our hotel are monitored by a closed circuit security camera system.

d. Transfer of Your Personal Data, Purpose and Legal Reason

Your Personal Data is shared with "Suppliers" and "Business Partners" with whom we have a business relationship and from whom we receive services, based on the legal grounds that data processing is mandatory for the legitimate interests of the data controller in accordance with Article 5/2 of the KVKK, the establishment or performance of a contract, the establishment, exercise or protection of a right, the fulfillment of a legal obligation, for the performance of contracts we have made for the procurement of necessary external services in relation to our activities and only for this purpose. For example; Your personal data is shared with the Lawyers from whom we receive services in the event of a legal dispute; Financial Advisors from whom we receive services due to financial liabilities, Auditors in case of audits, Travel Agencies and Companies from which you make reservations and purchases within the scope of transactions required for the execution of the contract, Banks from which payment transactions are made if necessary for transactions related to accommodation payments, Suppliers and Business Partners of these services in cases where external service provision is required regarding your accommodation and our services, Our Group Companies from which the relevant service is provided due to the execution of some services provided centrally (Sinpaş Holding, Kızılbük Gayrimenkul Yatırım Ortaklığı A.Ş., Sinpaş Gayrimenkul Yatırım Ortaklığı A.Ş.,It is shared with our Group Companies, Affiliates and Subsidiaries, primarily Kızılbük Kuşgölü Gayrimenkul Yatırımları Anonim Şirketi and GÜNEY EGE OTEL İŞLETMELERİ VE YONETİM HİZMETLERİ ANONİM ŞİRKETİ), and our Group Companies, Affiliates and Subsidiaries for the purpose necessary for the realization of the transaction.

7. Identity and arrival-departure records of hotel guests are transferred to General Law Enforcement Organizations and the State Institute of Statistics based on the legal reason that it is foreseen in the laws in accordance with Article 2 of the Identity Notification Law and for The Noor to fulfill its legal obligation.

8. Your name and surname, Turkish ID, accommodation date information is transferred to ''Insurance Agencies'' for the purpose of carrying out insurance transactions during your stay in our hotel and since data processing is mandatory for the establishment and protection of a right limited to this transaction.

9. Your Personal Data Processed for the Purpose of Sending Commercial Messages will be shared with Sinpaş Holding, Kızılbük Gayrimenkul Yatırım Ortaklığı A.Ş., Sinpaş Gayrimenkul Yatırım Ortaklığı A.Ş., Kızılbük Kuşgölü Gayrimenkul Yatırımları Anonim Şirketi and GÜNEY EGE OTEL İŞLETMELERİ VE YONETİM HİZMETLERİ ANONYMOUS ŞİRKETİ, primarily our main shareholders, affiliates, community and subsidiaries, service providers used for CRM, SMS and e-mail sending, searches, domestic and international software, servers, agencies and service providers and data processors that provide the necessary services to carry out our activities, measurement, targeting and profiling support, and İleti Yönetim Sistem A.Ş., based on your explicit consent, in order to be able to send you commercial electronic messages regarding other services and products.

It will be shared with our main shareholders, affiliates, community and subsidiaries, primarily Kızılbük Kuşgölü Real Estate Investments Joint Stock Company and GÜNEY EGE OTEL ENTERPRISES AND YONETİM HİZMETLERİ ANONİM ŞİRKETİ, and service providers used for CRM, SMS and e-mail sending, searches, domestic and international software, server, agency and service providers and data processors that provide the necessary services to carry out our activities, measurement, targeting, profiling support, and with İleti Yönetim Sistem A.Ş. based on your explicit consent.

10. Your personal data is transferred to the "Authorized Public Institutions and Organizations" in order for The Noor to fulfill its obligations regarding sharing information and documents arising from the legislation, to exercise its legal rights or in case of an urgent or mandatory health need; in case of a request and/or necessity for the fulfillment of a legal obligation, the establishment or protection of a right, the protection of the life or physical integrity of a person who is unable to give his/her consent due to a de facto impossibility or whose consent is not legally valid or of another person. (e.g. Courts, Police, Law Enforcement, Consumer Arbitration Committees)

11. Your Rights
To the extent your data is processed by The Noor, you have the rights stipulated in Article 11 of the Personal Data Protection Law No. 6698 regarding your personal data.
You can submit your requests within the scope of Article 11 of the Law regulating the rights of the relevant person, in accordance with the “Communiqué on the Procedures and Principles of Application to the Data Controller”, in writing or by using the registered electronic mail (KEP) address, secure electronic signature, mobile signature or the electronic mail address you have previously notified and registered in our system.
